Terms of Service

1. What This Service Is

Communications (comms.roarke.io) is a feedback and contact collection tool operated by Roarke Clinton. It provides embeddable widgets that allow visitors on participating websites to submit feedback or send messages.

By using the widget to submit feedback or contact messages, you agree to these Terms.

2. What You’re Agreeing To

  • Your feedback submission becomes part of our project records. We use it to improve the products and services where the widget is installed.
  • You grant us a perpetual, non-exclusive, royalty-free license to use, display, and act on your feedback in connection with improving our products.
  • You will not submit content that is illegal, abusive, threatening, or that infringes on the rights of others.
  • You will not attempt to exploit the widget for spam, injection attacks, or any purpose other than sending genuine feedback or messages.

3. No Expectation of Response

Submitting feedback does not create an obligation for us to respond, act on, or implement your suggestions. If you provide an email address, we may follow up, but this is at our discretion.

4. Your Data

Your data is handled as described in our Privacy Policy. In summary: we collect only what you submit, store it securely, and do not sell it.

5. Limitation of Liability

This service is provided “as is” without warranty of any kind. To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special, or consequential damages arising from your use of this service.
  • Our total liability for any claim related to this service is limited to the amount you have paid us (which is zero — the widget is free to use).
  • We are not responsible for losses arising from circumstances beyond our reasonable control.

6. Rate Limiting and Anti-Abuse

To prevent abuse, submissions are rate-limited to 5 per minute per IP address. We reserve the right to block submissions that appear to be automated, abusive, or in violation of these terms.

7. Governing Law

These Terms are governed by the laws of the State of Hawaii, United States, without regard to conflict of law provisions. Any disputes arising from these Terms will be resolved in the courts of the State of Hawaii.

8. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted. Continued use of the widget after changes constitutes acceptance of the new Terms.
